Our lawyers will help guide you through the process from start to end, and this includes explaining the numerous types of workers’ compensation benefits that are available. From death benefits to injured worker benefits, our legal team will provide you with the support and guidance you need to understand and obtain the benefits you deserve. Below you will find information on different types of workers’ compensation benefits.

Death Benefits

In the unfortunate case your loved one has been killed due to workplace negligence, you may be able to receive benefits. Oklahoma state law publishes a detailed worksheet that will go over the death benefits available to you, as well as how they are calculated. In most cases, beneficiaries will receive weekly death benefits that are calculated based on the deceased worker’s average weekly wage. It should be noted that weekly death benefits vary from case to case. However, they are also limited to the State’s Average Weekly Wage (SAWW) and are recalculated from time to time. Additionally, Oklahoma also offers lump-sum payments that can be received in the following ways:

  • Spouse: $100,000; and up to $10,000 for funeral expenses
  • Spouse and one child: $100,000 for spouse; $25,000 for child; and up to $10,000 in funeral expenses
  • Spouse and two or more children: $100,000 for spouse; $50,000 to be divided equally for each child; and up to $10,000 in funeral expenses
  • No spouse, one or more children: $25,000 per child, up to a maximum of $150,000, divided equally; and up to $10,000 in funeral expenses

Atkins & Markoff understands the emotional trauma that is associated with losing a loved one. We are committed to making the process of applying for death benefits as easy as possible and strive to handle all aspects of the case. Depending on the situation, families of the deceased worker may also be able to file a wrongful death claim, which our experienced legal team can walk you through.

Medical Benefits

Workers who have been injured on the job due to negligence of someone else may also be able to receive medical benefits that will cover past and future bills. In order to be eligible for these benefits, the injured worker in question must be able to prove that medical care is necessary to the recovery process. Our workers’ compensation attorneys will be able to call on our professional connections and medical experts in order to demonstrate that you are in need of medical and financial assistance.

Temporary and Permanent Benefits

Workers who have been injured on the job may be eligible to receive additional financial assistance, either temporarily or permanently. Temporary workers’ compensation benefits are typically awarded to those who are unable to work for three years. Permanent disability benefits may be granted to those who have sustained serious injuries that will keep them from returning to work. In order to receive permanent disability benefits, injured workers must undergo elaborate medical evaluations that will determine the extent of disability. Both of these types of benefits will be based upon the injured worker’s average income.
