Frivolous vs. Actual Personal Injury Lawsuits: What’s the Difference?

The A&M TeamPersonal Injury

Were you recently injured in an accident? If another individual was at fault, you could have a personal injury claim on your hands. Personal injury law involves the claims of individuals who have been “injured, physically or psychologically, as a result of the negligence or wrongdoing of another person, company, government agency or entity.”

At Atkins & Markoff, we pride ourselves on representing actual personal injury victims who have been actually wronged and who need actual help. We believe in the real personal injury law system that exists to bring justice to those carelessly harmed by others and that helps victims recover the compensation they deserve.

Unfortunately, over the years, “personal injury” has gotten a bad name, due to a host of frivolous lawsuits that have made headlines. If you come to Atkins & Markoff with “get rich” hopes and a bogus personal injury claim, we warn you in advance that we will not take on your case. Over the years, bogus personal injury claims have included the following:

McDonald’s was sued after its “hot” coffee burned a woman who suffered third degree burns (now their coffee cups contain a warning about the “hot” nature of their coffee)
One man sued Anheuser-Busch for emotional damages after he started drinking the beer and “bikini-clad women failed to materialize out of thin air”
One man sued Michael Jordan for “defamation and distress” after being mistaken for the NBA star his entire life
A man sued a flower company after the company sent a thank you note to his home after he purchased flowers (the flowers were for his mistress)
In 2005, a woman planted a fingertip in a bowl of Wendy’s chilli and proceeded to sue Wendy’s
As humorous as these stories are, the sad reality is that they discredit actual personal injury victims. Many personal injury victims hesitate before seeking legal representation because they view lawsuits as “frivolous.” We believe that when someone has been seriously injured, he/she deserves to be compensated for his/her injuries and other damages! An actual personal injury claim involves the following:

The person filing suffered injuries/damages

Another party acted irresponsibility causing these injuries/damages

The injuries/damages can be compensated for
