Most cases start with a phone call or an email. Our firm will usually get back to you immediately, or in a very short time. We will listen to your situation and first make a determination if we can help you. If we cannot, then we ALWAYS try to give you free advice, or at least point in the right direction where you can hopefully get help.
If you do have a case that we think we can handle, then we will usually arrange a meeting in the office or at your home. If that is not possible, then we can get the case started via the mail. We do like to meet all of our clients personally, but understand that is not always possible. We handle cases all over this country and depending on the type of case, we will often fly to meet you in whatever state you live in.
Once we meet and determine that we want to represent you and you would like to hire the firm, then we immediately begin trying to gather as much information as possible. If you were in an accident we may hire an expert to investigate it. If you took a defective drug, we will determine when you were prescribed it and how much you took. We basically want ALL the information that is available at the beginning of a case and whatever is not, we want to gather it as soon as possible.
Next we will get all of your medical records and bills together and if necessary, schedule meetings or get reports from your treating doctors to determine your medical condition. We never attempt to settle a case until you have finished medical treatment or until a doctor reaches a point where you are at least stabilized and can tell us how much future care will be necessary.
Once your medical treatment is complete or stabilized, we will generally make at least one attempt at resolving a case before filing a lawsuit. This is because filing a case can get very expensive and we always try to keep costs down if possible. If we cannot negotiate an acceptable settlement, then we will file a lawsuit and then the process is governed by the court. Deadlines are put in place and we begin the process of Discovery, which is us asking questions of the defendant or defendants and them asking questions of you. These will be both in written form and sworn questioning under oath, also called a deposition.
Once Discovery is complete, the court will usually order a mediation in an attempt to resolve the case and if that fails, then the case proceeds to trial.
Trials can take a few days or weeks, it just depends on how complex they are. Once a trial is concluded, either side has the option of an appeal and there is often one more attempt at reaching a settlement.
