If you and your spouse agree on everything, you may be able to file a waiver divorce. This is where one party files the petition and the other party agrees to the process and signs a document (waiver), which states that they choose not to be at the hearing. If the parties do not agree to the terms of the divorce then it is what is known as contested and the judge may ultimately have to decide the issues.
