As any expereinced Oklahoma City criminal defense lawyer will tell you, the benefits of expungement are great. Taking a closer look into your case for the possibility of a record expungement can really save you from the problems your charge may cause down the road when considering your public record.

Record Expungement in Oklahoma

The definition of expungement is the process by which a record of criminal conviction and/or arrest is removed by order of the court. In other words, it hasn't been wiped off the face of the earth, and depending on who is searching, there may be ways of pulling up the hidden information, but it is completely confidential and hidden from your public record. This means that if someone such as a potential employer decides to run a background check on you, there will be no evidence of the crime or charge whatsoever.

The way expungement works varies with each state. It is very important to look at the specific laws your state has for being eligible for an expungement. It involves looking at what your present record holds, looking at what kind of charge you were given, or possibly what kind of plea you made. With charges of drug possession, for example, the rules of eligibility for expungement are greater in Oklahoma than in California, making that kind of charge extremely difficult to be expunged from a record. There are also a lot of requirements, specifically in Oklahoma, when dealing with criminal charges. In those kinds of cases, nothing but the disposition/ sentencing from the crime has a possibility of being expunged. Other details, such as if the defendant is over the age of 18 or 21, also play a huge role in what kinds of charges meet the requirements for eligibility.

If you or someone you know has something on your public record that could be damaging to your future, it is well worth looking over. Contact the OK criminal defense attorneys of Atkins and Markoff to find out your eligibility in meeting the requirements necessary for an Oklahoma record expungement.
