At Atkins and Markoff, we strive to provide the best representation in Criminal Defense. Mark Bailey and Tommy Adler are very experienced trial lawyers with high success rates. They both practiced with the Oklahoma County Public Defender’s Office for a number of years. During Tommy Adler’s time at the Public Defender’s Office, he assisted in the training of new attorneys and drafted the manual still in use regarding the appropriate and professional representation of clients. During Mark Bailey’s time at the Public Defender’s Office, he gained the position of supervising attorney and was responsible for training other attorneys. Mark and Tommy serve, protect, and vigorously defend their client’s rights. Here are some of the many cases that Tommy and Mark have defended this year.

Cheerleader Stun Gun Case

Tommy Adler and Mark Bailey defended Julie Ann Bell in the cheerleader stun gun case. Julie Ann Bell was the mother of a cheerleader who did not make the tryouts at Putnam City North. LaShawn Fischer was committed and sentenced to five years for the attack with a stun gun on the Putnam City North cheerleading sponsor. Julie Ann Bell was charged with assault and battery with a dangerous weapon and conspiracy. Tommy and Mark vigorously defended her and she was found not guilty of both charges. A victory Tommy and Mark take with pride. Here is a link of an interview directly after the verdict and some photos:

Oklahoma Rape, Molestation and Lewd Acts Defense

Mark Bailey defended Phillip Dwayne Lout, in Pontotoc County, charged with multiple counts of rape, molestation, and lewd acts with a child. The allegations were based on a 13 year old who, after watching a video called “Get a New Daddy”, made allegations against Mr. Lout. This video encourages children to make up sexual abuse claims if they do not get what they want. Mr. Lout, 41, faced 16 felony counts and the jury could not come to a decision. A mistrial was declared Jan. 19, 2009. The following is a link to the news article: Comedy troupe song ‘Get A New Daddy’ leads to deadlocked jury

Oklahoma Manslaughter Defense

Mark Bailey is currently defending Don Mancil in Bryan County, which is still ongoing. Don Mancil is charged with Murder in the Second Degree. The case has proceeded through the preliminary hearing stage. Lastly, the ongoing pharmacy shooting case in SW Oklahoma City has received much attention. The Pharmacist Jerome Ersland, Anthony Morrison, Emmanuel Mitchell, and Jevontai Ingram are all charged with First Degree Murder and Morrison, Mitchell, and Ingram are being charged with conspiracy to commit felony as well. Video footage shows Jerome Ersland shooting the victim and because of this, people have been confused as to how four people are charged with murder. Tommy Adler was interviewed by KSBI and explained how all four can be charged with murder. He explains felony murder as; "The law holds a theory called felony murder," said Adler. "It means if you or anybody else agree to go on some sort of crime, and in the process, anybody dies for any reason, you can be charged with that person's murder. It's there on the books to deter people from planning deadly and dangerous crimes." Adler says in this case, the law goes after everyone involved, even if they didn't hold a weapon or go into the store.

If you are in need of an Oklahoma criminal defense attorney, Mark Bailey and Tommy Adler are well versed in the law and will protect your rights during this crucial time in your life. You will need someone who is professional, respectable, and who will vigorously defend you and, at Atkins and Markoff, Mark and Tommy will be that attorney for you.
