Mark Bailey defended Phillip Dwayne Lout, in Pontotoc County, charged with multiple counts of rape, molestation, and lewd acts with a child. The allegations were based on a 13 year old who, after watching a video called âGet a New Daddyâ, made allegations against Mr. Lout. This video encourages children to make up sexual abuse claims if they do not get what they want. Mr. Lout, 41, faced 16 felony counts and the jury could not come to a decision. Lastly, the ongoing pharmacy shooting case in SW Oklahoma City has received much attention. The Pharmacist Jerome Ersland, Anthony Morrison, Emmanuel Mitchell, and Jevontai Ingram are all charged with First Degree Murder and Morrison, Mitchell, and Ingram are being charged with conspiracy to commit felony as well. Video footage shows Jerome Ersland shooting the victim and because of this, people have been confused as to how four people are charged with murder. Tommy Adler was interviewed by KSBI and explained how all four can be charged with murder. He explains felony murder as; "The law holds a theory called felony murder," said Adler. "It means if you or anybody else agree to go on some sort of crime, and in the process, anybody dies for any reason, you can be charged with that person's murder. It's there on the books to deter people from planning deadly and dangerous crimes." Adler says in this case, the law goes after everyone involved, even if they didn't hold a weapon or go into the store.
