Abbott Laboratories Set to Pay $1.6 Billion for Depakote LawsuitsDepakote maker Abbott Laboratories has agreed to pay a total of $1.6 billion to settle claims that it allegedly marketed its anticonvulsant drug for off-label uses. The agreement marks the end of a four-year investigation into the marketing practice of Abbott, spurred by whistleblower claims that the drug firm marketed Depakote to doctors to treat autism, dementia and schizophrenia, even though it is only approved as a treatment for epilepsy, bipolar disorder and migraine headaches. While doctors are permitted to prescribe medications for off-label uses when they see fit, drug companies are prohibited from promoting their drugs for unapproved uses. Abbott is said to have engaged in this unlawful practice on an extreme level. |
Yaz Lawsuits Settled for Pulmonary Embolism and DVT, $218K Average AwardAccording to a report issued by Bayer last week, the drug maker has settled Yaz side effect lawsuits filed by 651 plaintiffs in the United States, agreeing to pay about $142 million or an average of $218,000 per claim. The drug firm has indicated however, that it is only settling lawsuits for venous clot injuries, including pulmonary embolism and deep vein thrombosis (DVT), at this time. The information was included in the "Legal Risks" section of Bayer's First Quarter 2012 Stockholder's newsletter, confirming recent reports that Bayer had begun to resolve some lawsuits associated with its potentially dangerous birth control pills. |

Trial Dates for Defective DePuy Hip Implant Lawsuits Set to BeginThousands of hip implant recipients throughout the United States have filed product liability lawsuits after experiencing problems with the DePuy Orthopaedics' recalled ASR hip replacement system, and the first trial date has been scheduled to start at the end of this year. According to a scheduling order issued by Nevada Judge Linda Bell, the first trial is set to begin on December 3, 2012 involving cases brought by three women in state court. All three women received DePuy hip implants and subsequently required revision surgery due to complications and failures with the defective hip replacement system. Additional trial dates are expected to begin in January 2013 in Maryland state court, and in March or April 2013 in the federal court system. |
Defective Swing Sets RecalledThe U.S. Consumer Product Safety Commission (CPSC) and Adventure Playsets announced a voluntary recall of approximately 240,000 swing sets. The recall affects seven models that were sold at Academy Sports, Mills and Menards, Mills, Toys-R-Us, and Wal-Mart between 2004 and 2007. All seven models are affected by the same defect; wood in the posts can weaken due to rotting, posing a falling hazard.
