As cell phones become more and more a storage place for all kinds of sensitive information, including bank PINs, credit card information and passwords, the issue of how much access the police can have to your phone without getting a warrant is cause for concern for many people. This question was presented before the Seventh Circuit Court of Appeals recently, in a case involving a man who was convicted of drug-related charges. His lawyers argued that police had conducted an unlawful search when they looked through his cell phones, one of which was on his person and two of which were in his vehicle, in order to verify the phone number of each device.

The high temperatures and seemingly endless drought have had many effects on Oklahoma. Surprisingly, one of those effects is a reduction in the amount of marijuana being grown in the state. OSBI has noted that the plants are unable to handle the intense heat and lack of rain. In previous years, Oklahoma has ranked in the top five states for its number of marijuana growers. The high temperatures, as well as the drought, have made it very hard to grow the plant within the state of Oklahoma. For this reason, some people have resorted to bringing marijuana in from other locations, otherwise known as drug trafficking.
Abbott Laboratories Set to Pay $1.6 Billion for Depakote Lawsuits
Depakote maker Abbott Laboratories has agreed to pay a total of $1.6 billion to settle claims that it allegedly marketed its anticonvulsant drug for off-label uses. The agreement marks the end of a four-year investigation into the marketing practice of Abbott, spurred by whistleblower claims that the drug firm marketed Depakote to doctors to treat autism, dementia and schizophrenia, even though it is only approved as a treatment for epilepsy, bipolar disorder and migraine headaches. While doctors are permitted to prescribe medications for off-label uses when they see fit, drug companies are prohibited from promoting their drugs for unapproved uses. Abbott is said to have engaged in this unlawful practice on an extreme level.
Yaz Lawsuits Settled for Pulmonary Embolism and DVT, $218K Average Award
According to a report issued by Bayer last week, the drug maker has settled Yaz side effect lawsuits filed by 651 plaintiffs in the United States, agreeing to pay about $142 million or an average of $218,000 per claim. The drug firm has indicated however, that it is only settling lawsuits for venous clot injuries, including pulmonary embolism and deep vein thrombosis (DVT), at this time. The information was included in the "Legal Risks" section of Bayer's First Quarter 2012 Stockholder's newsletter, confirming recent reports that Bayer had begun to resolve some lawsuits associated with its potentially dangerous birth control pills.
Rare Birth Defects May Result from Antipsychotic Drug Use in Pregnancy
According to a new study, women who take antipsychotic drugs like Risperdal and Seroquel during pregnancy may increase the risk of their child being born with movement problems. The research was published in the Archives of General Psychiatry, and found that pregnant women with mental disorders who took antipsychotic medications were more likely to give birth to babies with rare birth defects affecting their posture and movement, compared to children born to women who took antidepressant meds or no drugs during pregnancy.

Trial Dates for Defective DePuy Hip Implant Lawsuits Set to Begin
Thousands of hip implant recipients throughout the United States have filed product liability lawsuits after experiencing problems with the DePuy Orthopaedics' recalled ASR hip replacement system, and the first trial date has been scheduled to start at the end of this year. According to a scheduling order issued by Nevada Judge Linda Bell, the first trial is set to begin on December 3, 2012 involving cases brought by three women in state court. All three women received DePuy hip implants and subsequently required revision surgery due to complications and failures with the defective hip replacement system. Additional trial dates are expected to begin in January 2013 in Maryland state court, and in March or April 2013 in the federal court system.
Defective Swing Sets Recalled
The U.S. Consumer Product Safety Commission (CPSC) and Adventure Playsets announced a voluntary recall of approximately 240,000 swing sets. The recall affects seven models that were sold at Academy Sports, Mills and Menards, Mills, Toys-R-Us, and Wal-Mart between 2004 and 2007. All seven models are affected by the same defect; wood in the posts can weaken due to rotting, posing a falling hazard.
