Meet The Team

  • Jeff Atkins, Partner

    Mr. Atkins is a native Oklahoman, born and raised in Sapulpa, Oklahoma. He received his undergraduate degree in business administration from the University of Central Oklahoma where he was also a four-year member of the golf team. He obtained his law degree from The University of Oklahoma College of Law.

    While in law school he received the American Jurisprudence Award for his academic excellence in Conflicts of Laws and Professional Responsibility. Professional affiliations include: Association of Trial Lawyers of American, Oklahoma Bar Association, the William J. Holloway, Jr. American Inn of Court, and the American Trial Lawyers Association. Mr. Atkins is admitted to practice in all state and Federal Court Districts in Oklahoma. He has been selected as an Oklahoma Super Lawyer from 2008 – 2013. Mr. Atkins has been married for 15 years and has 2 children.

    In addition to his law practice, he is very active in his community and church. He currently serves on the board of Infant Crisis Services and the Rose Creek Property Owners Association, is entering his sixth season as a coach for his daughter’s soccer team in the Edmond Soccer Club, and co-teaches kindergarten Sunday School with his wife.

  • Daniel Markoff, Partner

    Mr. Markoff was born and raised in Houston, Texas, received his undergraduate degree from The University of Texas at Austin and his law degree from Oklahoma City University School of Law. He also studied Comparative Law at Oxford University, and Spanish at the Universidad de Valencia, in Valencia, Spain.

    While in law school, he was the recipient of the Raymond D. Naifeh Judicial Fellowship, and clerked for Oklahoma County District Judge Eugene H. Mathews. Prior to his law career, Mr. Markoff worked on the 1988 Presidential Campaign as National Advance Staff, and as the Immigration Coordinator for the Houston Volunteer Lawyers Program.

    Mr. Markoff was one of the first lawyers in Oklahoma to represent women injured by silicone breast implants and the diet drug combination, Fen/Phen. During those cases, and others, Mr. Markoff was interviewed by CNN, The CBS Evening News, Cosmopolitan Magazine and all major TV stations in Oklahoma City and Tulsa. He also represented and assisted Lynn Starks, who with the help of State Representative Leonard Sullivan, changed the laws regarding bunk bed construction statewide, nationwide and worldwide.

    Professional Affiliations include The Association of Trial Lawyers of America, Oklahoma Trial Lawyers Association, Oklahoma Bar Association, Oklahoma City University School of Law, Board of Directors, 1996-1998, Oklahoma City University School of Law Dean’s Circle 2001 – present, Oklahoma County Bar Association. Admitted to practice before the United States District Court for the Western District of Oklahoma.

  • Barry Davis, Partner

    Barry Davis is the Head of the Estate Planning Center at Atkins & Markoff. Mr. Davis was born in Havre de Grace, Maryland, raised in Tulsa, Oklahoma, received his undergraduate degree in 1971 from the University of Oklahoma and received his law degree from Oklahoma City University Law School in 1975.

    Mr. Davis has maintained a commercial and insurance trial practice in Oklahoma for over 38 years. He is a certified mediator, trained by the American Arbitration Association, and has mediated and arbitrated over 1,000 cases. Mr. Davis is a member of the Oklahoma Bar Association, the Oklahoma County Bar Association, and the Association of Attorney-Mediators. He has served as both Treasurer and Chairperson of the Alternative Dispute Resolution Section of the Oklahoma Bar Association. He is licensed to practice law by the Supreme Court of Oklahoma, the United States District Courts for the Western District of Oklahoma, and the United States Court of Appeals for the Tenth Circuit.

    Barry Davis has been recognized for “Rated AV Preeminent for over 12 years as Highest Possible Peer Review Rating in Legal Ability and Ethical Standards” by Martindale-Hubbell Peer Review Rating & Client Review. Mr. Davis has been married for 38 years and has 3 children.

    Besides his work as an attorney, he teaches an adult sunday school class and is an active participant in church choir. Mr. Davis is also involved in a prison ministry called the Oklahoma Messages Project sponsored by Redeeming the Family, an Oklahoma non-profit corporation.

  • Tommy Adler, Partner

    Tommy Adler was born and raised in Oklahoma City and now lives with his family in Norman, OK. He graduated from Bishop McGuinness Catholic High School in Oklahoma City. He received his undergraduate degree in Public Relations and Journalism from the University of Oklahoma. He received his Juris Doctorate Degree from the University of Oklahoma College of Law with a focus on Constitutional Law.

    During law school, Mr. Adler gained exposure to the practice of criminal defense law as a legal intern with the Oklahoma City criminal defense firm of J.W. Coyle. After graduation, Mr. Adler worked for three years as a Public Defender in Oklahoma County in the felony trial division. He represented clients in thousands of cases ranging from misdemeanors to murders. Mr. Adler left the public sector to begin his career in private criminal defense as the founding attorney of the Atkins and Markoff Law Firm Criminal Division.

    During his career, Mr. Adler has been successful in winning either a dismissal or a not guilty verdict for his clients in over 95% of his cases that have been called for jury trial. Mr. Adler is an alumnus of the Western Trial Advocacy Institute located in Laramie, WY where he studied criminal defense litigation under a host of the nation’s most respected criminal defense trial lawyers.He has also attended post-graduate training at the Absolute Criminal Defense Litigator’s Conference in Las Vegas, NV and has regularly attended the Pat Williams Criminal Defense Institute sponsored by the Oklahoma Criminal Defense Lawyer’s Association.

    Mr. Adler is married and he and his wife have three beautiful children. Mr. Adler and his wife are long-time members of Journey Church in Norman, OK. Mr. Adler enjoys traveling with his wife, golf, running, and following the OKC Thunder and OU sports with his son. He also enjoys cooking, fishing, and his annual mission trips to Haiti.

  • Brian Jones, Associate

    Brian Jones was born and raised in Talihina, Oklahoma. He graduated from Talihina High School in 2002, and enrolled in St. John’s College in Annapolis, Maryland. At St. John’s, he served as Student Body President and was a representative to the College’s Board of Visitors and Governors. He graduated from St. John’s in 2006 and enrolled in the University of Oklahoma College of Law. He was a member of the Oklahoma Law Review and the Civil Rights Moot Court Team, received the American Jurisprudence Award for Academic Excellence in the study of Capital Punishment, was on the Dean’s List for three years and graduated with Distinction in 2009.

    While in law school he interned with Kator, Parks & Weiser of Austin, Texas, developed an election law manual for the Oklahoma Democratic Party, studied Native American law as a clerk with Hobbs, Straus, Dean & Walker, and interned with the criminal defense division of Atkins & Markoff. After passing the bar in 2009, Brian opened his own practice in Shawnee, Oklahoma, where he gained experience in a wide range of legal areas and developed his trial skills as a working lawyer.

    In his first bench trial, he defeated a former district court judge, and later overcame a summary judgment motion in a mergers and acquisitions case by an attorney with twenty-plus years of experience in the field. In July of 2010, he became an associate attorney with the Hunsucker DUI Defense Firm. He returned to Atkins & Markoff in December of 2010, as an attorney with the firm’s criminal defense division. Brian enjoys reading and spending time with his wife, Jenne, and their sons Oscar and GuyJack.

  • Mason Johnston, Associate

    Mason Johnston was born and raised in Mena, Arkansas. Mr. Johnston earned his undergraduate degree from the University of Arkansas where he was a double major in Sociology and Criminal Justice. He received his Juris Doctorate from the Oklahoma City University School of Law in 2013. During his first year of law school, Mr. Johnston worked as a law clerk in another personal injury firm.

    He then joined the team of Atkins & Markoff as a Legal Licensed Intern, allowing him to handle cases and make certain court appearances on behalf of the firm’s clients with the supervision of a senior partner. Our clients were so impressed with Mr. Johnston’s efforts on their behalf while he was a Legal Licensed Intern, he had already begun receiving referrals, the highest form of compliment an attorney can have. Mr. Johnston’s decision to go to law school came as a result of his own life experiences.

    Having lost his father to malignant mesothelioma while in high school, his family began the long and difficult process of litigation against the manufacturers and other defendants involved in the production and use of the deadly asbestos. It was through this experience that Mr. Johnston realized the true practice of law came not in grandstanding in the courtroom, but in the day to day help and counseling lawyers provide to their clients.

    It is his goal to provide his clients with the best legal service he can during what is often one of the most difficult times in their life. When Mr. Johnston is not working for you, he enjoys spending time with his wife, Jessica, hunting, golfing, and being with his close friends and family. Mr. Johnston also enjoys rooting for the Arkansas Razorbacks.

  • Melanee Kistler, Associate

    Melanee McAfee Kistler was born and raised in Tulsa Oklahoma, where she received her undergraduate degree from the University of Tulsa, majoring in Advertising/Public Relations.

    She worked at Gilcrease Museum for four years as Association Secretary, taking minutes for a 40-member board of directors as well as organizing museum functions and art sales.

    After becoming engaged to her husband, she moved to Oklahoma City to work for the Cowboy Hall of Fame and Western Heritage Center as Editorial Assistant for museum publications. She also helped organize events for the prestigious Western Heritage Awards, presenting awards with guest celebrities.

    She embarked on a career change when her daughters were still in grade school and began attending OCU law school. She became a Certified Mediator through the Oklahoma Supreme Court Early Settlement Mediation Program, mediating small claims cases upon referral from district court judges.

    After law school, she worked on the Fen Phen litigation with Phillips, Murrah during the discovery phase of the complex litigation for the opt-out lawsuits.

    She later spent six years working for Oklahoma Child Support Services, managing an interstate caseload and taking remedies to enforce court orders. Another part of her job involved locating assets and employment information for the establishment of paternity and support orders.

    In 2012 she opened her own law firm, focusing her practice on family law and social security disability claims. She recently became the contract attorney for Atkins and Markoff, representing claimants in social security hearings before Administrative Law Judges throughout the state.

    Her professional associations include membership in the Family Law and Juvenile Law sections of the Oklahoma Bar Association, and the Women in Law Committee where she participates in community service projects. She is also admitted to the United States District Court for the Western District of Oklahoma.

    She and her husband, Steve, have been married for 27 years and have two marvelous daughters. Lindsay, 25, is in her second year at OU Law School and Hillary, 23, is in the Speech Pathology program at UCO.

  • Richard Smalley, Associate

    Mr. Smalley is a second generation attorney who was born and raised in Oklahoma. Originally from Clinton, he relocated with his family and graduated from Noble High School. He received his undergraduate degree from the University of Central Oklahoma and in 2004, he earned his law degree from the University of Oklahoma, College of Law.

    Mr. Smalley joined the Atkins and Markoff Law Firm in 2014 as the head of the firm’s Family Law Division. Prior to joining the firm, Mr. Smalley practiced Family Law for ten years. During his time in law school and the early years of his professional career, Mr. Smalley practiced alongside his father at the firm of Smalley & Associates. Most recently, Mr. Smalley served as a member of the matrimonial law firm, Echols & Associates. While at the firm Mr. Smalley handled a wide variety of complex matrimonial and family law cases.

    In 2013, Mr. Smalley received an “AV Preeminent” rating from his peers through Martidale-Hubbell, which is the highest possible rating in both legal ability and ethical standards.

    Mr. Smalley is happily married and has two amazing children. He and his family now live in Blanchard, Oklahoma. In his free time, Mr. Smalley enjoys coaching and cheering on his children in their sporting activities.
